3 business days — W. Va. Code 46A-2-132 (home solicitation; buyer's right to cancel; notice) et seq. (46A-2-133 form of agreement; 46A-2-134 restoration of down payment). FTC Cooling-Off Rule (16 CFR Part 429) also applies.
The law
- W. Va. Code 46A-2-132 through 46A-2-135 (home solicitation — cancellation right; form; restoration of down payment; no compensation for pre-cancellation services)
- W. Va. Code 46A-6-101 et seq. (WV Consumer Credit and Protection Act, unfair/deceptive practices)
- FTC Cooling-Off Rule, 16 CFR Part 429
Contract notes
No solar-specific consumer protection statute located. The WVCCPA is notably pro-buyer: a seller who performs services before cancellation or before giving the required statement gets NO compensation for them (W. Va. Code 46A-2-135), and down payments must be restored within 10 days of cancellation (46A-2-134); a clause letting the seller keep any part of the payment is void. Misrepresentation claims run under the WVCCPA (W. Va. Code 46A-6-101 et seq.).
